<P >拿出钱来扔了进去。日前，广西壮族自治区南宁市西乡塘区人民法院对广西玛雅传销案进行一审宣判。玛雅公司因非法经营罪被处罚金<FONT face="Times New Roman">300</FONT>万元。该公司的<FONT face="Times New Roman">5</FONT>名主要负责人赵德强、<st1:PersonName w:st="on" ProductID="黄朝">黄朝</st1:PersonName>君、赵德光、赵艳梅、黄洋因非法经营罪被判处有期徒刑及并处或单处罚金。<FONT face="Times New Roman"> <o:p></o:p></FONT></P>

<P > 广西玛雅生物科技有限公司成立于<st1:chsdate w:st="on" IsROCDate="False" IsLunarDate="False" Day="26" Month="10" Year="2001"><FONT face="Times New Roman">2001</FONT>年<FONT face="Times New Roman">10</FONT>月<FONT face="Times New Roman">26</FONT>日</st1:chsdate>，公司地址位于广西南宁市大学路，主要生产销售一种名为“生物霖<FONT face="Times New Roman">(</FONT>灵<FONT face="Times New Roman">)</FONT>”的生物促进剂，所谓的生产，其实只是买了别的牌子的肥料和其他添加剂再加工。<FONT face="Times New Roman"> <o:p></o:p></FONT></P>

<P > 由于产品销路不畅，公司面临倒闭。<FONT face="Times New Roman">2004</FONT>年<FONT face="Times New Roman">5</FONT>月，他们开始打着“扶贫支农”的幌子，采取所谓的“公司<FONT face="Times New Roman">+</FONT>农户”的合作模式进行经营。交<FONT face="Times New Roman">288</FONT>元赚<FONT face="Times New Roman">1060</FONT>元，半年时间能翻近<FONT face="Times New Roman">4</FONT>倍，要是买<FONT face="Times New Roman">10</FONT>万就能赚回近<FONT face="Times New Roman">40</FONT>万，这样美丽的肥皂泡吸引了全国各地的做着发财美梦的人争相加入。截至<FONT face="Times New Roman">2005</FONT>年<FONT face="Times New Roman">4</FONT>月警方展开调查时，该公司的传销网络已经发展到全国<FONT face="Times New Roman">30</FONT>个省区市，<FONT face="Times New Roman">50</FONT>多万人因此上当受骗。<FONT face="Times New Roman"> <o:p></o:p></FONT></P>

<P > 法院审理认为，被告单位广西玛雅生物科技有限责任公司违反《国务院关于禁止传销经营活动的通知》、《国务院办公厅转发工商局等部门关于严厉打击传销和变相传销等非法经营活动意见的通知》的规定，实施具有传销性质的“扶贫支农”营销模式，扰乱市场秩序，情节严重，其行为已构成非法经营罪。被告人赵德强是所在单位直接负责的主管人员，被告人<st1:PersonName w:st="on" ProductID="黄朝">黄朝</st1:PersonName>君、赵德光、赵艳梅、黄洋在明知玛雅公司实施的“扶贫支农”营销模式是传销的情况下，仍为该行为的实施提供帮助。赵德强、<st1:PersonName w:st="on" ProductID="黄朝">黄朝</st1:PersonName>君、赵德光、赵艳梅、黄洋的行为均已构成非法经营罪。据此，法院依法判决广西玛雅生物科技有限公司犯非法经营罪，判处罚金<FONT face="Times New Roman">300</FONT>万元人民币；赵德强犯非法经营罪，判处有期徒刑<FONT face="Times New Roman">5</FONT>年，并处罚金<FONT face="Times New Roman">50</FONT>万元人民币；<st1:PersonName w:st="on" ProductID="黄朝">黄朝</st1:PersonName>君犯非法经营罪，判处有期徒刑<FONT face="Times New Roman">3</FONT>年，并处罚金<FONT face="Times New Roman">10</FONT>万元人民币；赵德光犯非法经营罪，判处有期徒刑<FONT face="Times New Roman">3</FONT>年，并处罚金<FONT face="Times New Roman">10</FONT>万元人民币；赵艳梅犯非法经营罪，判处有期徒刑<FONT face="Times New Roman">2</FONT>年缓刑<FONT face="Times New Roman">2</FONT>年，并处罚金<FONT face="Times New Roman">5</FONT>万元人民币；黄洋犯非法经营罪，单处罚金<FONT face="Times New Roman">5</FONT>万元人民币。<o:p></o:p></P>
